Taken from the HPC File Staging Profile document:

DataStaging - CreationFlag

"As in [JSDL10], but with the clarification that it is not considered an error if the CreationFlag is set to 
dontOverwrite and a file with the same name exists at the target location."

A similar clarification might be worthwhile.
