The application could have different program flows
depending on the fact if the file exists or not,
but if app tries to open the file, usually because
it needs the info.

  Comment:
Declined: that issue was discussed in the group, and we felt that the sentence as is is true.  For example, the application may create a new file, or 
try another location to find the data etc.  

Ever tried strace -f /bin/true 2>&1 | grep open | grep ENOENT?  The return value is still 0 ;-)
